Same-Sex Divorce in Massachusetts
In May of 2004, same-sex couples obtained the right to marriage in Massachusetts. The groundbreaking case, Goodrich v. Department of Public Health set the precedent that allowed for this breakthrough in civil rights. This legal right allows same-sex couples to finally enjoy all of the "protections, benefits and obligations" associated with marriage. Similarly same-sex couples have the right to divorce under Massachusetts laws as well. Same-sex divorce proceedings are essentially identical to heterosexual divorce proceedings.

Jurisdiction Is a Critical Issue in Divorce
One of the important issues that needs to be addressed in any divorce case is the question of jurisdiction. Individuals must be resident of Massachusetts for two of the last three years to obtain a divorce in Massachusetts. Couples may also file for divorce here if they can prove the cause of the divorce took place in Massachusetts.
